We listed a Freddie Mac property last week and after 4 offers in 3 days it was sold to an out of state buyer that paid over the asking price. This is not unusual because all 4 bank owned properties we've listed this year have sold in less than a week over the list price. It is very common for investors and locals that have been out bid 2 or 3 times to race to a newly listed foreclosure and make an offer over the listing price! Why would anybody do that? HMMMM.. A NEWLY LISTED SHORT SALE??

SHOULD I CONSIDER BUYING A NEWLY LISTED SHORT SALE?? I JUST EMAILED THESE THOUGHTS TO A NEW MEMBER AND WANTED TO SHARE IT WITH ALL OF YOU.

The seller needs someone to come along, make an offer, and get his short sale on the 6 to 24 month conveyor belt. Lenders will not process anything until there is an offer. The waiting time is determined by the lender and until they decide it's time to take a bath. Lenders are not obligated to grant a short sale and only do so when it is to their financial advantage. The seller and the listed price have no real meaning until the lender decides to do an appraisal and sometimes 3 or 4 until they get the dollar amount they want. This happens after they approve the short sale and many times just before closing, At that time the lender will give everybody a real price. If they buyer walks (very common) the seller can now advertise "Approved Short Sale" and on to short sale attempt #2 !

The lender usually has up until the day of closing to tell the seller if they are going to issue a deficiency judgement. At that point the seller ( and a day before closing and months or years of waiting for the buyer ) can back out... Sellers will many times back out of the sale and opt for filing bankruptcy rather than pay a $100K or more judgement.

THIS GETS BETTER. If there is a second mortgage in place, the seller and buyer needs their approval too before they will release their lien on the property. Many times a second mortgage was sold off to dozens of investors and they all have to approve losing money. It is common that days before closing, SURPRISE, the lien holders in second position wants $5,000, $10,000 or more to release their lien and they are looking for the buyer to pay .... There is nothing simple, easy, or straight forward about a SHORT SALE.
